Welcome to Make It Mine Designs. These Terms of Service (“Terms”) govern your use of the Make It Mine Designs website, online stores, products, services, text messaging program, and your purchase of custom or non-custom products from us.

By accessing our website, submitting an order, requesting a quote, approving a design, subscribing to our messaging program, or purchasing products or services from Make It Mine Designs, you agree to these Terms. If you do not agree with these Terms, please do not use our website, subscribe to our messaging program, or purchase our products or services.

Make It Mine Designs provides custom signage, graphics, apparel, vehicle graphics, promotional products, tint and glass services, and related products and services.

 

2. Custom Orders and Projects

Many of our products and services are custom-made specifically for individual customers.

Custom projects may include, but are not limited to:

• Signs and banners

• Vehicle graphics, wraps, decals, and lettering

• Custom apparel

• Embroidery and decorated garments

• Promotional products

• Graphics and printed materials

• Installation services

• Other customized products or services.

Because custom products are created specifically for the customer, specifications, colors, dimensions, materials, quantities, artwork, and other project details should be carefully reviewed before an order is approved.

 

3. Apparel Protection

Apparel is subject to manufacturer sizing, garment-color, and dye-lot variations. If an item becomes unavailable, Make It Mine Designs may provide a comparable substitution with customer approval. Minor variations in logo placement and decoration may occur. Customer-supplied garments are decorated at the customer’s own risk and are not the responsibility of Make It Mine Designs for damage, shrinkage, or other issues. Custom garments are non-returnable due to fit, sizing, or personal preference. Garments that are defective or incorrectly produced may be submitted for inspection and, if confirmed, will be repaired, replaced, or otherwise remedied at Make It Mine Designs’ discretion.

 

4. Unclaimed Finished Orders

Finished orders must be picked up within 30 days of notification. Beginning on the 31st day, unclaimed orders may be subject to a storage fee of $5 per day. Make It Mine Designs reserves the right to dispose of or otherwise handle unclaimed property in accordance with applicable South Dakota law, including any required notices and procedures.

 

If a finished order remains unclaimed and/or unpaid after reasonable notice to the customer, Make It Mine Designs may exercise any rights and remedies available under applicable South Dakota law, including any applicable lien, sale, or other lawful disposition rights. Before selling or otherwise disposing of property, Make It Mine Designs will provide any notices and follow any procedures required by South Dakota law.

 

5. Quotes and Estimates

Quotes and estimates are based on the information available to us at the time the quote is prepared. A quote may change if the scope of a project changes, including changes to quantity, size, materials, artwork, design requirements, installation requirements, shipping, delivery, or other specifications requested by the customer. Unless otherwise stated on a written quote, estimates are not guaranteed final prices. A quote does not constitute acceptance of an order until Make It Mine Designs confirms the order.

 

6. Customer Approval and Proofs

For applicable custom projects, we may provide a digital, printed, or other proof for customer review. The customer is responsible for carefully reviewing the proof before approving production. By approving a proof, the customer confirms that the spelling, names, dates, numbers, colors, logos, images, dimensions, layout, and other project details are correct. Once a customer approves a proof and production begins, changes may require additional charges and may not be possible. Make It Mine Designs is not responsible for errors appearing in an approved proof, except when the finished product materially differs from the approved proof because of our production error.

 

7. Customer-Provided Artwork and Content

Customers may provide logos, artwork, photographs, text, designs, trademarks, or other materials for use in a project. By submitting materials to Make It Mine Designs, you represent that you have the legal right and appropriate permission to use and reproduce those materials for the requested project. You agree not to provide materials that infringe another person's or company's copyright, trademark, patent, publicity rights, privacy rights, or other intellectual-property rights. You are responsible for obtaining any necessary permissions, licenses, releases, or authorizations for materials you provide. Make It Mine Designs may refuse to produce material that we reasonably believe may violate the law or another person's rights.

 

8. Design and Artwork Services

When Make It Mine Designs creates original artwork, layouts, designs, or other creative materials for a customer, ownership and permitted use of those materials may depend on the terms of the specific project. Unless otherwise agreed in writing, payment for a finished product does not automatically transfer ownership of Make It Mine Designs' underlying design files, working files, templates, production files, or proprietary processes. If you require ownership or delivery of editable design files, those arrangements should be agreed upon in writing before production.

 

9. Pricing and Payment

Customers agree to pay the price stated on an approved quote, invoice, online order, or other written agreement. Payment may be required before production begins, at the time of order, upon completion, or according to other payment terms established for the project. We may require a deposit or full payment before beginning certain custom projects. For customers with approved account terms, invoices are due according to the payment terms stated on the invoice. Past-due balances may be subject to reasonable collection costs, late charges, or other remedies permitted by law and applicable agreement.

 

10. Changes and Cancellations

Because many of our products are custom-made, cancellation or modification of an order may not be possible after materials have been ordered or production has begun. If you request a cancellation or change, we will make reasonable efforts to accommodate the request when possible. The customer may be responsible for costs already incurred, including materials purchased, design work completed, production time, labor, shipping, special-order products, and other non-refundable costs. Custom orders that have entered production generally cannot be cancelled without applicable charges.

 

11. Returns and Custom Products

Custom-made, personalized, decorated, or otherwise specially produced products may not be eligible for return or refund solely because the customer changes their mind or no longer wants the product. If a product arrives damaged, defective, or materially different from the approved order, please contact us as soon as reasonably possible so we can evaluate the issue and determine an appropriate resolution. Any return, replacement, repair, or refund will be handled according to the circumstances of the order and applicable law.

 

12. Product Colors and Materials

Colors displayed on computer monitors, phones, tablets, proofs, and other electronic devices may differ from actual printed, painted, embroidered, vinyl, or manufactured colors. Material appearance may also vary because of manufacturing processes, lighting, surface conditions, batch differences, and other factors. Make It Mine Designs will make reasonable efforts to produce products consistent with the approved specifications, but exact color matching cannot always be guaranteed unless a specific color-matching process has been agreed upon.

 

13. Production and Completion Times

We will provide estimated production or completion times when reasonably possible. Estimated completion dates are not guaranteed unless a specific completion date is expressly agreed to in writing. Production times may be affected by material availability, supplier delays, shipping delays, customer approval delays, design changes, equipment issues, staffing, weather, or circumstances outside our reasonable control. We are not responsible for delays caused by circumstances beyond our reasonable control.

 

14. Shipping, Delivery, and Pickup

Customers are responsible for providing accurate shipping, delivery, and contact information. Once an order is shipped to the address provided by the customer, responsibility for delays or loss caused by the carrier may be subject to the carrier's terms and applicable law. Customers picking up orders are responsible for inspecting products within a reasonable period after pickup and notifying us of any apparent issue. Special delivery or installation arrangements may be subject to additional charges.

 

15. Installation Services

When Make It Mine Designs provides installation services, the customer is responsible for providing reasonable access to the installation location and notifying us of known site conditions that may affect installation. Additional charges may apply if unexpected conditions require additional labor, materials, equipment, travel, or work. For vehicle graphics, signs, window graphics, and similar installations, the condition of the surface can affect the installation and final result.

 

Make It Mine Designs is not responsible for damage caused by pre-existing damage, defective surfaces, improperly prepared surfaces, rust, corrosion, paint failure, structural defects, or conditions outside our control.

 

16. Vinyl Installation and Removal

Vinyl installation and removal may be affected by the condition of the paint and clear coat, rust, corrosion, oxidation, repairs, prior bodywork, existing graphics, or adhesive. Customers are responsible for disclosing repainted, repaired, or chemically treated surfaces before installation. Make It Mine Designs is not responsible for damage discovered during vinyl removal when caused by pre-existing conditions or underlying surfaces.

Installation and removal may be delayed by weather, temperature, humidity, or required cure times. Vinyl lifespan varies based on exposure, maintenance, surface condition, and storage. No specific service life is guaranteed unless stated in writing.

 

17. Customer Responsibilities

Customers are responsible for providing accurate information necessary to complete their orders.

This includes, where applicable, names and spelling, dates and numbers, measurements, addresses, contact information, vehicle information, artwork and logos, product selections, sizes and quantities, and other project specifications. Customers are responsible for reviewing all information before approving an order or proof.

 

18. Website Use

You may use our website for lawful purposes only.

You agree not to:

• Use the website for unlawful activity;

• Attempt to gain unauthorized access to our systems;

• Interfere with the operation or security of the website;

• Upload malicious code or harmful material;

• Copy or misuse website content without permission;

• Submit fraudulent orders;

• Impersonate another person or business; or

• Use the website in a manner that could damage or interfere with our business or other users.

We reserve the right to refuse or cancel orders that appear fraudulent, unlawful, abusive, or otherwise inappropriate.

 

19. Website Content and Intellectual Property

Unless otherwise stated, content appearing on our website including logos, graphics, photographs, designs, text, artwork, and other materials is owned by or licensed to Make It Mine Designs and is protected by applicable intellectual-property laws. You may not reproduce, modify, distribute, sell, publish, or commercially exploit our website content without our written permission. Customer-owned trademarks, logos, photographs, and other materials remain the property of their respective owners.

 

20. Customer Project Photos and Portfolio Use

Unless otherwise agreed in writing, Make It Mine Designs may photograph completed projects and use photographs of completed work for legitimate business purposes, including our website, social media, portfolio, advertising, and promotional materials. If a customer does not want a completed project photographed or used for promotional purposes, the customer may notify us in writing. We will make reasonable efforts to honor such requests for future use.

 

21. Third-Party Products and Services

Some products, materials, payment services, shipping services, or other components used in connection with an order may be supplied by third parties. Third-party products and services may be subject to the manufacturer's or provider's own terms, warranties, limitations, and policies. Where applicable, we may assist customers in communicating with the relevant manufacturer or provider regarding warranty or service issues.

 

22. Payment Processing and Third-Party Services

Online payments and certain other services may be processed through third-party providers. When you use a third-party payment or service provider, your information may be handled according to that provider's terms and privacy policy. Make It Mine Designs is not responsible for the independent privacy, security, or business practices of third-party providers.

 

23. Make It Mine Designs Text Messaging Program

The Make It Mine Designs Text Messaging Program is operated by Make It Mine Designs in Mitchell, South Dakota.

By opting into our text messaging program, you agree to receive text messages from Make It Mine Designs at the mobile telephone number you provide.

Our text messaging program may be used to communicate with customers regarding:

• Appointment reminders;

• Quotes and estimate updates;

• Order confirmations;

• Order and project status updates;

• Pickup and delivery notifications;

• Invoice and payment reminders;

• Customer-service communications;

• Responses to customer inquiries;

• Account or service information; and

• Promotional or marketing messages when you have provided the appropriate consent.

Message frequency varies.

The number of messages you receive depends on your orders, appointments, projects, account activity, customer-service interactions, and communication preferences. Promotional messages may be sent periodically and are not guaranteed to follow a specific schedule.

Your mobile carrier may charge you for text messages or data according to the terms of your wireless plan.

Opting Out

To stop receiving Make It Mine Designs text messages, reply STOP to any text message from us.

After you send STOP, you may receive one confirmation message, after which you will no longer receive text messages from us unless you provide consent again.

You may also contact us directly to request assistance with opting out.

Opting out of promotional text messages does not necessarily prevent us from communicating with you through other methods or sending communications that are necessary to complete an existing transaction or provide services you have requested.

 

Your consent to receive promotional text messages is not a condition of purchasing goods or services from Make It Mine Designs.

 

We may collect and use your mobile phone number and information about your SMS consent and communications to operate our messaging program, provide customer service, communicate with you about your orders or services, and send messages for which you have provided consent.

We do not sell or share mobile phone numbers, SMS consent, or text-message originator opt-in data with third parties or affiliates for their own marketing or promotional purposes. Information may be provided to service providers only as necessary to deliver and support the messaging service.

 

24. Privacy Policy

Our collection, use, storage, and protection of personal information is described in our Privacy Policy. By using our website or services, you acknowledge that you have had an opportunity to review our Privacy Policy.

 

25. Marketing Communications

If you provide your contact information, we may communicate with you about products, services, promotions, or other information that may be relevant to you. You can opt out of marketing emails by using the unsubscribe instructions included in the email or by contacting us directly. For marketing text messages, follow the SMS opt-out instructions in Section 23. Even if you opt out of marketing communications, we may still contact you regarding transactions, orders, appointments, customer-service matters, or other communications necessary to provide services you have requested.

 

26. Disclaimer of Warranties

To the fullest extent permitted by law, our website and its content are provided on an “as available” basis. We make reasonable efforts to provide accurate information, but we do not guarantee that the website will always be uninterrupted, error-free, or completely accurate. Product warranties, if any, are limited to the warranties expressly provided for the applicable product or service. Nothing in these Terms is intended to exclude or limit any warranty or consumer right that cannot legally be excluded or limited under applicable law.

 

27. Limitation of Liability

To the fullest extent permitted by applicable law, Make It Mine Designs will not be responsible for indirect, incidental, special, consequential, or punitive damages arising from the use of our website, products, or services, except to the extent such limitation is prohibited by law. Nothing in these Terms is intended to limit liability that cannot legally be limited or excluded.

 

28. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Make It Mine Designs and its owners, employees, contractors, and service providers from claims, damages, losses, liabilities, and expenses arising from:

• Materials or artwork you provide;

• Your violation of these Terms;

• Your violation of another person's intellectual-property or other legal rights; or

• Your unlawful use of our website or services.

29. Force Majeure

Make It Mine Designs is not responsible for failure or delay in performing its obligations when caused by circumstances beyond our reasonable control. Such circumstances may include severe weather, natural disasters, fire, labor disruptions, equipment failure, supplier shortages, transportation delays, government actions, utility interruptions, internet or technology failures, or other events beyond our reasonable control.

 

30. Governing Law

These Terms are governed by the laws of the State of South Dakota, without regard to conflict-of-law principles. Any legal action relating to these Terms or our products or services shall be brought in a court of appropriate jurisdiction in South Dakota, unless applicable law requires otherwise.

 

31. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

 

32. No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce that provision in the future.

 

33. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted on our website with a revised effective date. Your continued use of our website or purchase of products or services after updated Terms are posted constitutes acceptance of the updated Terms, to the extent permitted by law. For an individual custom project, the written quote, invoice, order confirmation, or project agreement may contain additional terms that apply specifically to that project.
